These Terms and Conditions (“Terms”) outline the rules and regulations for using our website, accessing our services, and engaging with our business as a client, visitor, or customer. These Terms constitute a binding legal agreement between you and The Beauty Jem concerning the use of the website and booking of services.

By accessing or using our website (www.thebeautyjem.com), you agree to these Terms in full. If you do not agree, please refrain from using our site or services.

I. Who Can Use This Website

You must be at least 18 years old to use this website or book services, or you must have permission from a parent or guardian. For clients under 18, a signed parent or guardian consent form is required prior to any appointment. By using our site, you confirm that you have the legal authority to enter a binding contract.

II. Booking and Payment Terms

All prices are listed in CAD and are subject to change at any time without notice.

A $20 non-refundable deposit sent via e-transfer to beautybyjemdj@gmail.com is required to secure your appointment. All services are offered by appointment only and are subject to availability.

Remaining balances must be paid at the time of service via cash, e-transfer, The Beauty Jem gift vouchers, or other accepted methods.

No-shows or cancellations made with less than 48 hours’ notice will result in forfeiture of the deposit and may be charged the full service amount before rebooking is allowed.

III. Ownership of Content and Intellectual Property

All content, images, logos, brand elements, and copy on this website are the intellectual property of The Beauty Jem. You may not use, reproduce, copy, distribute, or republish any materials without our express written consent.

IV. Right to Modify Services and Pricing

We reserve the right to modify, update, discontinue, or change service offerings and pricing at any time without prior notice. This includes changing availability, service duration, or product features.

V. Warranties and Service Limitations

While we strive to offer high-quality services, we do not guarantee results due to varying individual characteristics such as skin sensitivity, skin condition, lash cycle, hair cycle, hormonal changes, lifestyle factors, and aftercare adherence. All clients are expected to follow our pre- and post-care guidelines.

We do not guarantee:

That your results will be identical to reference photos or client examples.
That your lashes, skin, or brows will respond to services in a particular way.
That treatment outcomes will be consistent from session to session.
That the site will be free of errors, interruptions, or vulnerabilities at all times.

VI. Limitation of Liability

The Beauty Jem is not liable for any personal injury, allergic reaction, medical complication, loss, or damage caused by or connected to our services. By booking, you assume full responsibility for disclosing any relevant medical or skin conditions.

To the extent permitted under British Columbia and Canadian law, The Beauty Jem shall not be held liable for:

Any direct, indirect, incidental, punitive, or consequential damages arising from use of this Site or our services;
Allergic reactions, sensitivities, or other outcomes resulting from the services if relevant pre-existing conditions were not disclosed;
Temporary or permanent cosmetic results or dissatisfaction arising from personal preferences.

Advanced treatments, including, but not limited, to chemical peels, dermaplaning, and microneedling, carry inherent risks such as temporary redness, peeling, sensitivity, hyperpigmentation, and rare adverse reactions. By booking any advanced service, you acknowledge these risks and confirm you have disclosed all relevant medical history, medications, and skin conditions. Signed consent forms are required for all advanced treatments and are kept on file in accordance with our insurance requirements.

Clients are responsible for following all provided pre-care and aftercare instructions.

VII. Updates to Terms

We may update these Terms at any time, and such changes will be effective immediately upon posting. Continued use of the site or services indicates acceptance of the revised Terms. We recommend reviewing this page periodically.

VIII. Promotional Emails and Communications

By providing your email, you consent to receive appointment updates, promotional offers, newsletters, or announcements. You may unsubscribe at any time using the opt-out link included in each email.

IX. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein. Any disputes arising under these Terms shall be resolved exclusively in British Columbia courts.

Before initiating any court proceedings, both parties agree to attempt resolution through good-faith mediation with a mutually-agreed BC-based mediator. If mediation fails to resolve the dispute within 60 days, either party may proceed to the courts of British Columbia.

Any dispute arising from these Terms or your use of our services shall be resolved on an individual basis. You agree not to participate in any class action, class-wide arbitration, or representative proceeding against The Beauty Jem.

X. Indemnification

You agree to indemnify, defend, and hold harmless The Beauty Jem and its owner from any claims, liabilities, losses, or damages (including legal fees) arising from:

Your use of our website or services
Any breach of these Terms
Any violation of applicable laws or third-party rights

XI. Force Majeure

The Beauty Jem shall not be liable for any failure or delay in providing services due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government orders, power outages, illness, equipment failure, or supply chain disruptions. In such cases, we will make reasonable efforts to reschedule affected appointments.

XII. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

XIII. Use of Website

You agree not to use this website:

For any unlawful purpose;
To solicit others to perform or participate in unlawful acts;
To violate any provincial, federal, or international regulations;
To infringe upon our intellectual property or the rights of others;

If you submit reviews, testimonials, comments, or feedback on our platforms, you grant us the right to use, reproduce, and share this content for marketing purposes. Content that is offensive, defamatory, or violates others' rights will be removed.

XVI. Photography, Video, and Marketing Use

During your appointment, we may take before-and-after photographs, videos, or other content of your treatment results for use in our portfolio, website, social media (Instagram, TikTok, Facebook), and marketing materials.

Faces will not be shown in shared content unless you provide explicit written or verbal consent at the time of service. You may decline photography or content capture at any time without any effect on your service or experience.

If you have previously consented and later wish to have specific content removed, please contact us at beautybyjemdj@gmail.com and we will remove it from our owned platforms within a reasonable time frame. Please note that content already shared on third-party platforms (e.g., reposts, screenshots) cannot always be fully removed.
